Rule 103
To manage the productivity
(1) The agency that has been approved to remove trees in accordance with this paragraph shall, at its own expense, cut, mow and collect the trees, plants and other vegetation and deposit them at the place designated by the Divisional Forest Officer. But soft perishable trees in Ghatgadwadi within one year and trees in right of way outside the forest area can be auctioned on the basis of valuation.
(2) The work as per sub-rule (1) shall be completed under the direction of the Forest Officer of the Division Forest Office and the forest produce shall be handed over to the Division Forest Office.
(3) In the case of forests managed by community forest consumer groups, the forest produce shall be transferred to the concerned consumer group under the authority of the representative of the working committee of the concerned consumer group while acting as per sub-rule (1). However, in the case of forests that have been used for development projects under section 42 of the Act before the formation of community forest user groups, the forest yield obtained as per sub-rule (1) shall belong to the Government of Nepal.
(4) After the collection of wood and firewood according to sub-rule (1): The annual allowable cutting quantity of the action plan should be reviewed and included in the action plan.
(5) According to rule 90, if stone, gravel or sand is released during the development project within the national forest area, the project may use the fee as determined for riverine forest production as per Schedule-8.
(6) If the stone, gravel or sand extracted according to sub-rule (5) is not used by the related project, the relevant local level shall sell it on the basis of open competition on the recommendation of the Division Forest Office.
